can anyone suggest what to do regarding possible cheat by ebay seller

friends ,
some day ago i received an ebay 10percent discount coupon and on 25th aug i saw an ebay advt in dj scrolling about lyfflame7 phone,and on opening it saw seller is selling it for 3650,so it seemed good deal,seller also wrote about giving sim with item, but had 0 feedback, i contacted the seller, he said he is distributor of mobile and since he is new no-feedback and also promised he will use id-documents only for genuine purpose [for my sim] only, so i purcased the item and paid money by mobikwik and also sent the scanned documents.
i also got message from him that he is very genuine and will do his best and ship the item on saturday, but today i again was checking about matter and saw he wrote in shipping that item will be shipped by speedpost, but on his feedback saw,some buyer wrote "seller is cheater and sent only box without phone" and that made me worried and i wrote seller a message asking why he is sending itme by speedpost,when he said courier and what about feedback and previously he always responeded but today no-reply from him
and things seem suspicious.

Now please suggest what todo?
since i had paid by mobikwik money is already paid?
ebay will not cancel transaction?
if i not take item and return it, can i claim item not received?
if i take item,ebay will not easily return item?
what can i do form my documents?

never buy anything (i mean anything) on ebay with a seller feedback negative or not at all(0 feedback)..
it's the thumb rule of ebay
secondly
you can't cancel the item as it's against ebay policy and only the seller from his/her side can cancel by mutual understanding..
lastly things you can do-(your money is with ebay currently but it can return to you)
1. notify ebay
2. try contacting the seller and ask him to cancel
3. when the package arrives don't claim it and let it return
4. accept item and then don't open the package and then return asking ebay

there is 50-50 chance for your money to be safe..
check for similar offers on ebay with (a different seller but with again 0 feedback) might be he the same guy..

well said....never buy is it is a new seller....& also do check seller ratings before buying on ebay

If u want to buy from ebay then check seller's rating(must be 80+) to avoid fraudulent.
Now contact ebay for this issue only they can solve ur problem

ebay won't do anything in this matter until the package itself arrives
also they won't cancel it without sellers will

Purchased twice from ebay.. once from a reputed seller.. got a faulty phone and he never initiated a return.. he just keep on saying take to service center and cut call.. second time.. from a new seller.. and it ended up way worse in a phone that doesnt even start..

both times ebay was saying they cant return money or take product back.. and with that i learned never to buy anything from ebay..

Amazon works in same way but they always refund me even if the seller is a fraud.

Best Advice to you.. NEVER EVER AND EVER BUY ANYTHING EVEN FROM A REPUTED SELLER FROM EBAY..

Buy from Amazon or Flipkart even if it costs few ruppees extra.. if second hand.. try olx or quickr..

Now about your case.. what my friend did is ask ebay to refund money cause seller is a fraud and you dont need product.. when you get product.. accept it and unpack infront of the delivery person or go pick up and unpack infront of post office people.. then go file a case against ebay on consumer court if ebay refuses to take any action.. my friend got 17k for it on 13k phone issue. once again.. Never trust Ebay and sellers there.

Seller is fraud hence,No chance to cancel

seller is sending item by speedpost, if i dont take package and return it,then can i claim for undelivered item?

Its easy make a opening video , if phone is not there then send the video to ebay

I agree with you
@ron, you should make a unboxing video (also take video pictures of order number clearly )of that product and send the video to ebay for proof. surely they will take action against the seller !

sorry..guys if seller is a cheater..he never relay on video....better contact ebay
